Assam Assembly Passes Polygamy Prohibition Bill; Sent for Presidential Assent

The Assam Legislative Assembly on Thursday passed the Assam Prohibition of Polygamy Bill, 2025, which aims to legally prohibit and eliminate polygamy and polygamous marriages within the state, promoting gender equality. The bill has now been forwarded to President Droupadi Murmu for her approval and assent to become law.

 Key Provisions and Punishment

 

  • Penal Offence: The bill makes polygamy a punishable offence. A first-time violation carries a penalty of up to seven years of imprisonment and a fine.

  • Increased Penalty: Anyone who conceals an existing marriage to enter into a second marriage could face up to ten years in prison and a fine.

  • Exemptions: Significantly, the bill does not apply to areas under the Sixth Schedule of the Indian Constitution or to members of any Scheduled Tribe (ST), respecting the constitutional autonomy and customary laws of these communities.

🗣️ CM Sarma’s Defence and UCC Commitment

 

Assam Chief Minister Himanta Biswa Sarma strongly defended the legislation, asserting that it does not conflict with Islam and that “true Islamic people will welcome this Act.” He pointed out that countries like Turkey have banned polygamy, and Pakistan has mechanisms to address similar issues. Furthermore, the Chief Minister reiterated his commitment to introducing the Uniform Civil Code (UCC) in Assam, stating, “If I return to the assembly as the Chief Minister, I will bring the UCC in the first session of the assembly.”
